In Memoriam: Clayton Helriggle 09/27/07


09/27/07. This evening, in a cemetary in Preble County - where there is buried more than one murder victim whose case is saturated in wrongdoing - the Helriggle family and their supporters will celebrate Clayton's short life.
Clayton was a young man who was truly loved by his family and respected by his community. When speaking with citizens about Clayton's murder, one never hears the typical statements that might be heard about the victim of a drug raid...."that kid was always trouble" or "it was just a matter of time till this happened". The death of Clayton Helriggle was a tragedy of the greatest and most undeserved magnitude.
Coupled with unbearable grief of the family is the infuriating knowledge that they must find a life for themselves without their child due to one deputy's jealous vendetta. The deputy's wife had publicly flirted with Clayton weeks earlier in a local bar.
The power the United States gives to federal, state and local authorities is mighty, and so should be the justice that rights any PURPOSEFUL wrongs done by these authorities. The civil trial for this case was as bungled as the raid and the motives behind it.
Preble County is the poster child for a needed statute which requires outside investigators and prosecution of official wrongdoing AWAY from the jurisdiction in which it occured (and that does not include nearby jurisdictions where there could be authorities who would help cover up any wrongdoing). There is a legal system of checks and balances in place just so situations like Clayton's never occur. It took a team of local authorities to manipulate paperwork and investigations to help the responsible deputy beat prosecution for this outlandish crime.
May every authority who had a hand in this heinous crime reap what they sow in every aspect of their life, and in the eternity that awaits them.

Corruption Press Release #1



Corruption allegations in Preble County, Ohio, result in complaint to Department of Justice
Dozens of cases alleging corruption in Preble County, Ohio, have resulted in a class action complaint addressed to the Department of Justice. Allegations include acts of intimidation, harassment, retaliation, false charges, deals for false witnesses, evidence/document destruction, drugs and homicides.
The county of 42,000 citizens has a high number of cases with peculiar and questionable circumstances. The complaint alleges citizens in Preble County have been subject to official wrongdoing for over twenty years by a specific group of authorities, suggesting the acts of wrongdoing could possibly fall under the RICO Act. Additionally, many cases are alleged to have been carried out “under the color of law”, meaning crimes were committed while officials were acting in their official capacity.
Websites and local online forums hint of a sinister underbelly of corruption. A victim shot in the head, wrapped in sheets, partially burned then buried under floorboards declared a suicide. A triple homicide, “unsolved”, with terrified whisperings in the county of participation by authorities. A murder, with a man serving time in prison, and the likely perpetrators remain uninvestigated and rumored to have close relationships with authorities. A “drug raid” on a young man’s home, organized and led by a deputy whose wife had flirted with the young man. The raid netted a few prescribed pain pills, a small amount of marijuana and a pipe. The young man died from a bullet to the chest as he came walking down the stairs with a blue beverage cup in his hand. Authorities insist he was carrying a gun.
Authorities remain steadfast in their claim that citizens are “roused up” due to area rumors and activity on local websites and forums. Victims and their survivors have congregated on the web, and have presented an impressive body of work consisting of news accounts, witness statements and court documents. Sheriff Mike Simpson and County Prosecutor Martin Votel have asserted the position that anyone is welcome to approach them with information about a case. The complaint to Washington suggests a fear of sharing information with local investigators. Further issues in the complaint allege supervisors know or have been given evidence of wrongdoing and have not properly addressed or investigated certain authorities.
Years ago frustrated citizens created the Preble County Citizen’s Task Force Against Corruption. Many came to meetings or shared information with organizers long distance by mail. There amassed an unsettling amount of alleged wrongdoing, and incredible stories of devastated lives and families. Guy Scott Sr., founder of the Task Force, is hoping to see the new prosecutor in Preble County indicate a desire to “clean the place up”.
Websites and local forums were created by citizens and have gained a nationwide audience. A documentary has been filmed on one of the cases and at least two books are in progress. Let's talk about...the RICO Act


“racketeering activity” means (A) any act or threat involving murder, kidnapping, gambling, arson, robbery, bribery, extortion, dealing in obscene matter, or dealing in a controlled substance or listed chemical (as defined in section 102 of the Controlled Substances Act), which is chargeable under State law and punishable by imprisonment for more than one year; (B) any act which is indictable under any of the following provisions of title 18, United States Code: ...

...section 1503 (relating to obstruction of justice)
...section 1510 (relating to obstruction of criminal investigations)
...section 1512 (relating to tampering with a witness, victim, or an informant)
...section 1513 (relating to retaliating against a witness, victim, or an informant)
(4) “enterprise” includes any individual, partnership, corporation, association, or other legal entity, and any union or group of individuals associated in fact although not a legal entity;
(5) “pattern of racketeering activity” requires at least two acts of racketeering activity, one of which occurred after the effective date of this chapter and the last of which occurred within ten years (excluding any period of imprisonment) after the commission of a prior act of racketeering activity;

Title 18, U.S.C., Section 242Deprivation of Rights Under Color of Law

This statute makes it a crime for any person acting under color of law, statute, ordinance, regulation, or custom to willfully deprive or cause to be deprived from any person those rights, privileges, or immunities secured or protected by the Constitution and laws of the U.S.This law further prohibits a person acting under color of law, statute, ordinance, regulation or custom to willfully subject or cause to be subjected any person to different punishments, pains, or penalties, than those prescribed for punishment of citizens on account of such person being an alien or by reason of his/her color or race.

Acts under "color of any law" include acts not only done by federal, state, or local officials within the bounds or limits of their lawful authority, but also acts done without and beyond the bounds of their lawful authority; provided that, in order for unlawful acts of any official to be done under "color of any law," the unlawful acts must be done while such official is purporting or pretending to act in the performance of his/her official duties. This definition includes, in addition to law enforcement officials, individuals such as Mayors, Council persons, Judges, Nursing Home Proprietors, Security Guards, etc., persons who are bound by laws, statutes ordinances, or customs.

Punishment varies from a fine or imprisonment of up to one year, or both, and if bodily injury results or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire shall be fined or imprisoned up to ten years or both, and if death results, or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

Now, if an official were to be engaging in other activities, let's say ... drug transactions, then that would not be considered an act of that person's official duties, even when performed during work hours or in work uniforms.

If, however, an official took vengeance on a person who they had a greivance with - such as false charges and buying false witnesses - and was able to perpetrate these charges as part of their official position, the scenario is exactly what this statute is addressing.

When an official commits crimes over and over again, that falls under the RICO Act...

Media and Corruption In Preble County


If the truth is ever going to be exposed in Preble County, it will require a federal investigation. Getting to that point requires first exhausting all local and state resources. The many cases require notariety before investigators take an interest beyond a file they have been assigned to lying around the office. And that takes a public interest to compell an investigator to action.
One of the cases has a documentary which has been completed. two cases have books in various stages of development. We have been approached by two investigative journalists, and we are discussing a documentary of all cases with a filmmaker. Archives contain three decades of news reports.
The Citizens Task Force Against Corruption enabled many cases to compare information and has resulted in a stockpile of documents. An entire history of cases involving official wrongdoing has been created, complete with court documents and witness statements. The intricacies of any particular case as well as a detailed picture of the corruption as a whole is available to media sources.
All media is welcome to make inquiries, and will be assisted in compiling information necessary to broadcast these stories.

"Good ole boys" supporters



Preble County has long been plagued by the devastation left behind after the "good ole boys" have done what they wish with the law. Children removed from their parents in acts of harassment/retaliation, persons spending the rest of their lives in prison, and death. This is a county of barely over 40,000 citizens, with an uncomfortable amount of unsolved homicides, many with indications of official wrongdoing.

Victims, survivors, supporters and doubters converge on websites and local forums addressing these cases. Everyone has their own opinion, which brings about the advantage of seeing these cases from all points of view and is as it should be.

Some posts display little consciousness or humanity.

Investigations...



Most investigations of cases in Preble County never go beyond the local level - a problem.

In the Consolidated Rd triple homicide, Ohio BCI was eventually called in. The investigation went on for years. At one point an agent told a family member that they were aware that Preble County was one of the most corrupt in all of Ohio.

Years ago, a Citizen's Task Force was created in the area and they amassed a collection of cases in which there are serious allegations against authorities who had given themselves free rein to do as they wish. The network of cooperation succeeded in bringing false charges, buying and coaching witnesses, manipulating and destroying documents and evidence, harassiment, intimidation, and physical harm.

The internet has made it possible for victims to find each other and realize they are not alone in their individual cases of wrongdoing. The internet has also introduced Preble County to the nation. We thank the journalists who have contacted us and always welcome more.
